Effects Caused by the Deviation between Realistic Laws and Idealistic Laws on Legal Terms Translation: Case Study on “duchuangxing” in Copyright Law Term

Abstract:

Different interpretations of legal terms, due to the deviation between realistic laws and idealistic laws, may give rise to inappropriate translation, which, in turn, hampers the communication with those legal terms. The term “duchuangxing”, because of such deviation, should not be translated into originality without exception. The paper, based on the analysis of the discrepancy between the Chinese term “duchuangxing” and its English counterpart, attempts to present the translation policy of its own and holds that the principle of synchronicity should be observed as well in term translation.
