Differentiation of “Legal Interpretation” and “Legal Construction”

Abstract

Abstract: The turnaround of hermeneutics led to a divergence between the position on methodology and the position on ontology in the philosophical hermeneutics. The universal methodology of humanities turned into the human's way of life, since then the terms of “explanation” and “interpretation” appeared, which led to different legal connotations of “legal interpretation” and “legal explanation”. Distinguishing the two terms has academic significance in legal conceptualism, political philosophy, and moral philosophy.
