Discussion on the Term Identity of Indigenous Intellectual Property Rights from the Perspective of Descriptive Terminology

Abstract:

Based on prescriptive opinions, this paper attempts to give a descriptive explanation on the term identity of indigenous intellectual property rights. The author holds that “indigenous intellectual property rights” and “intellectual property rights” are neither synonymous terms nor in an inclusion relation, regardless of the common ground in conceptual meaning. The phrase, indigenous intellectual property rights,is not a legal term, instead, it is a policy term.
