Discussion on the Nomenclature of the Generic Name of Chinese Patent Medicinal

Abstract:

Based on contrasting a series of principles and laws, such as the principles of nomenclature of the generic name of western medicine, the relevant provisions of the Traditional Chinese Medicine Law, the naming principles and process of the terminology of traditional Chinese medicine (TCM), etc., we found there are many problems in the Technical Guideline Principle for the Nomenclature of the Generic Name of Chinese Patent Medicinal(draft for soliciting opinions). We propose to develop the principles of naming TCM terms in conformity with the characteristics of TCM, to protect TCM and its culture, and to protect Chinese patent medicinal brands. Moreover, we think that we cannot cut off the history of TCM and lose its intellectual property rights, and cannot do one-size-fits-all in renaming work. We also think that the nomenclature of TCM should be considered from the dimensions of legal, economic, and public aspects. It is critical to establish management system consistent with the characteristics of TCM, and to enhance national self-confidence and cultural self-confidence.
