教育法典总则编核心词语的选择

摘要:

编纂法典是梳理法律、建构体系的立法活动。教育法典的编纂需要选择建构型教育法典模式作为体例结构。筛选的核心词语应围绕三个方面:《民法典》编纂经验、《宪法》和其他教育单行法中提炼词语的价值内涵、总则体系的完整程度。以此选择出三个核心词语:基于教育法律属性选择“教育法律关系”,基于核心词语品格选择“教育法律行为”,基于总则体系的完整程度选择“教育法律责任”。

Abstract:

Codification is a legislative activity to organize laws and construct a system.The codification of the education code requires the selection of a constructive education code model as the body structure.The selection of core terms should be centered on three aspects:the codification experience of the Civil Code,the value connotation of the terms extracted from the Constitution and other separate laws on education,and the degree of completeness of the system of general provisions.Three core terms are selected:“educational legal relationship” based on the legal attributes of education,“educational legal behavior” based on the character of the core terms,and “educational legal responsibility” based on the degree of completeness of the general rules system.
